What the draft covers legally
The template reflects the key mandatory rules of Austrian residential tenancy law (as of August 2026):
- Scope: full or partial application of the MRG as a selectable variant – with the reference-value rent (§ 16(2) MRG) or a freely agreed main rent.
- Fixed terms: written form and a 3-year minimum (§ 29 MRG); at least 5 years since 1 Jan 2026 when the landlord is a business (5th MILG). Tenant break right after year one; 25% fixed-term discount under full application (§ 16(7) MRG).
- Rent & running costs: 10% VAT on residential rent, the closed operating-cost catalogue of §§ 21–24 MRG, floor-area allocation (§ 17 MRG), annual statement by 30 June (§ 21(3) MRG).
- Indexation: CPI adjustment under the rent-indexation act (MieWeG) – at most once a year per 1 April, within the statutory caps.
- Deposit: separate, interest-bearing investment and prompt return with interest (§ 16b MRG); up to 3 gross monthly rents is customary.
- Maintenance: mandatory landlord duties under § 3 MRG and § 1096 ABGB – including rented-out boilers and water heaters.
- Formalities: energy certificate duty (EAVG 2012), no stamp duty on residential leases since 11 Nov 2017, joint liability of co-tenants, § 15a MRG category grades, handover protocol and annex checklist.
- Limits: not suitable for commercial leases, complex sublet or flat-share setups, cooperative, tied or holiday flats – those need individual advice.
